This engagement has elements that could be read as 1099-compatible (independent control over schedule, own equipment) but also hybrid signals (project-based work with fixed scope, pay by hour). Under California's AB5 / ABC test, the C-prong requires the worker to be customarily engaged in an independently established trade — verify this before approving as 1099.

Worker misclassification is the single largest compliance risk in contractor hiring. This free tool applies the IRS common-law test and state-specific variants like California's AB5 / ABC test to a potential 1099 engagement. You answer questions about control, integration, and trade; we return a risk tier (low, medium, high), a written rationale, and a factor-by-factor breakdown. Nothing you enter is saved in a profile — we store only the score and the email you provide so we can email you the result.

Classification assessment

Takes about 2 minutes. Every question is based on the IRS common-law test and relevant state rules.

1. Do you dictate the worker’s schedule or set working hours?
1099 contractors typically set their own hours.
2. Does the worker use company-provided equipment or systems?
Laptop, software licenses, office space, etc.
3. Is the worker supervised day-to-day by a manager (not just reviewed at milestones)?
4. Is the work the worker performs part of your core business?
A software company hiring a software engineer = core business.
5. Is the engagement indefinite (rather than a defined project or term)?
6. Does the worker customarily serve other clients (or can they freely)?
A key ABC-test factor, especially in California.
7. Does the worker operate as their own business (LLC, sole prop, business license)?
8. Is the worker paid a fixed salary-like amount regardless of output?
1099 is more typically project fee or hourly against deliverables.
9. Does the worker receive benefits (health, PTO, 401k)?
10. Is the worker prohibited from working with competitors during the engagement?

How the scoring works

  1. You answer 10 questions covering four categories: behavioral control, business integration, worker trade status, and financial relationship.
  2. Each answer carries a weight based on how that factor affects the classification analysis in real case law. Control factors carry the highest individual weight because courts and the IRS look at them first.
  3. State adjustments apply. If the worker is in California, Massachusetts, New Jersey, or another ABC-test state, the trade factor (whether the worker runs an independently established business) weights higher because the ABC test's C-prong is the most commonly failed.
  4. You get a tier and a rationale. Low, medium, or high risk, with a written explanation of which categories drove the result.
  5. The rationale is written for a reviewer, not a machine. The output is meant to be readable by HR, legal, or a hiring manager, not just a compliance engine.
